Note: These terms are based on our solicitor-drafted T&Cs and supplemented with digital product terms. They are being reviewed by our solicitors ahead of full launch. By purchasing access to our platform you agree to these terms.
Better Business Expert Limited (“BBE”) is registered in England and Wales (Company No. 07090303), VAT No. 985 8527 53. Registered office: 18 Oriel Close, Walkington, Beverley, East Yorkshire, HU17 8YD.
By purchasing access to our platform or any individual tool, you agree to be bound by these Terms of Use. If you are purchasing on behalf of a business, you confirm you have authority to bind that business to these terms.
When you purchase access to our platform (in whole or in part), you are purchasing a non-exclusive, non-transferable licence to access and use the specified digital tools for your own business purposes. This is not a purchase of software ownership.
Paid subscriptions are priced in bands according to the number of people your business employs — not the number who use the platform. Everyone in your business may have a login at no additional cost.
We take headcount to mean the people employed by your business, including part-time staff and working directors. The platform counts the people in your People records (not counting leavers) and the logins on your account, and uses whichever is higher. You cannot choose a band smaller than that number.
If your business grows beyond your current band:
Adding data never changes what you pay. Only your headcount sets your band.
Our tools are digital products. Under the Consumer Rights Act 2015, you have the right to a 14-day cancellation period for digital content unless you have consented to immediate access. By choosing “Continue to secure payment” and completing checkout, you acknowledge that you are requesting immediate access to digital content and that your right to cancel under the Consumer Contracts Regulations begins from the moment access is granted.
Refunds: Because our tools are digital products with immediate access, we are not obliged to provide a refund once access has been granted. However, if you experience a technical fault that prevents access, please contact us within 7 days and we will resolve the issue or provide a refund at our discretion.
You may not:
All content, tools, frameworks, methodologies and materials within the BBE platform are the intellectual property of Better Business Expert Limited and are protected by copyright. The licence granted to you does not transfer any intellectual property rights. You may not copy, reproduce or distribute any part of our tools without our written consent.
Data you enter into our tools (your business data, employee records, assessment results) remains your property. We process it only to provide the service.
We process personal data in accordance with our Privacy Policy and applicable UK GDPR requirements. Where you use our tools to hold or collect data about other people — employees, colleagues, survey respondents or customers — you are the Data Controller and we act as your Data Processor. The Data Processing Terms in Schedule 1 form part of these terms and apply to that processing.
When you invite people to a survey or to give feedback, you are responsible for having a lawful basis to contact them and for telling them how their information will be used. Invitations are sent in your company's name, and replies go to you.
When you use our tools, the figures and answers you enter are stored against your company's account and remain your property. We also use this information in an anonymised and aggregated form to produce benchmarks — for example, the typical gross margin for manufacturers in Yorkshire employing 10 to 24 people.
Anonymised and aggregated means your company is never named, and that figures are combined with those of other businesses before anyone sees them. We do not publish benchmarks for any group small enough that an individual business could be identified from them.
These benchmarks are part of what the service provides: they are how we can tell you whether a result is good or poor for a business like yours, rather than simply reporting it back to you. They may also be used, in the same anonymised form, in our own research, reports and marketing.
If you would prefer your data was not used in this way, tell us and we will exclude your account. Doing so does not affect your access to any tool, but your results will be shown without comparison figures.
Our tools are designed to support good business decision-making, not to replace professional legal, financial or HR advice. Nothing in our tools constitutes legal, financial, tax or employment advice.
Artificial intelligence. Some tools use artificial intelligence to write summaries, themes, reviews and suggested actions. AI output can be incomplete or wrong. Treat it as a draft for you to check, not as advice, and review it before you rely on it, act on it or share it. You remain responsible for any decision you make about a person or your business.
BBE's total liability to you in respect of any losses arising under or in connection with your use of our platform shall not exceed the total amount paid by you to BBE in the 12 months preceding the claim.
We shall not be liable for: loss of profits, loss of business, loss of data, indirect or consequential losses, or any loss arising from your reliance on the output of our tools without taking independent professional advice where appropriate.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
We aim to keep the platform available at all times but cannot guarantee uninterrupted access. We may update, improve or modify tools from time to time. We will endeavour to notify you of significant changes. We reserve the right to withdraw individual tools or features with reasonable notice.
We may suspend or terminate your access if you breach these terms, without liability to you. You may close your account at any time by contacting us. On termination, your licence to use the tools ends. See our Data Erasure Request page if you wish your data to be deleted.
These terms are governed by the law of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

These terms apply where we process personal data on your behalf (Article 28 UK GDPR). “You” are the controller; “we” are the processor.
We process the data only on your documented instructions, which are these terms and your use of the platform, unless the law requires otherwise; if so, we will tell you first unless the law prevents it. We will tell you if we believe an instruction breaks data protection law.
Everyone we authorise to process the data is bound by a duty of confidentiality.
We take appropriate technical and organisational measures to protect the data, including encryption in transit, database rules that keep each business's data separate, restricted administrative access, and anonymity safeguards for staff survey and 360 feedback responses.
You authorise us to use the sub-processors listed in section 5 of our Privacy Policy. We will give you at least 30 days' notice, by email or on that page, before adding or replacing one, and you may object on reasonable data protection grounds. We impose data protection obligations on each sub-processor equivalent to these and remain responsible to you for their performance. International transfers are made under the safeguards described in the Privacy Policy.
Taking into account the nature of the processing, we will help you respond to requests from people exercising their rights, and with your security, breach notification, data protection impact assessment and prior consultation obligations.
We will notify you without undue delay, and in any event within 48 hours, after becoming aware of a personal data breach affecting your data, with the information you reasonably need to meet your own obligations.
When your account closes, we will at your choice return the data to you or delete it within 30 days, and delete remaining copies unless the law requires us to keep them. Anonymised and aggregated benchmark figures (section 10) are not personal data and are not affected.
We will make available the information reasonably needed to show that we meet these obligations and allow for, and contribute to, reasonable audits or inspections by you or an auditor you appoint, on reasonable notice and subject to confidentiality.
