3. Why We Process Your Data (Legal Basis)

4. Data You Enter About Other People

When a business uses our People Management Platform, staff surveys, 360 degree feedback or customer surveys, that business is the Data Controller for the people concerned (its employees, colleagues and customers) and we act as its Data Processor. The business is responsible for having a lawful basis for that data and for telling those people how it is used. Some of this information can be sensitive — for example absence, wellbeing or assessment records — and the business must also have a condition under Article 9 of UK GDPR for any health data it records.

We process this data only on the business's instructions, under the Data Processing Terms in Schedule 1 of our Terms of Use, and share it only with the service providers listed in section 5. If you are an employee or a survey respondent and want to use your data rights, please contact the business that holds your data; we will help them respond.

5. Who We Share Your Data With

We use a small number of service providers (sub-processors) to run the platform. Each is bound by a contract that requires it to protect the data and use it only to provide its service to us.

Some of these providers are based in, or may process data in, the United States. Where personal data leaves the UK we rely on the UK–US Data Bridge where the provider is certified under it, or on the UK International Data Transfer Addendum to the European Commission's Standard Contractual Clauses.

We do not sell, rent or trade your personal data, and we share it with no one else unless the law requires us to.

6. Benchmarking

We use the information entered into our tools, in anonymised and aggregated form, to produce sector and regional benchmarks.

What we use. Financial figures, scores and assessment answers, together with the sector, region, size and turnover band recorded against your company. We do not use names, contact details, or anything that identifies an individual.

Our lawful basis. Legitimate interests — providing a comparison service that is a core part of what our customers are paying for, and improving it. We have considered the impact on you and concluded it is minimal, because data is aggregated before use and no business is identifiable in the output. We do not publish benchmarks for any group small enough that an individual business could be identified from them.

Your right to object. You can ask us to exclude your company's data from benchmarking at any time by contacting us. We will do so, and your access to the service will not be affected.

Retention. Aggregated benchmark figures contain no personal data and are kept indefinitely. The underlying records are kept as set out in section 7.

6A. Artificial Intelligence

Some tools use artificial intelligence (Anthropic's Claude) to write summaries, draw themes from written comments and suggest actions. For 360 degree feedback and staff surveys, the AI receives the combined results and the comments without anyone's name attached, and only the themes it produces are kept — the comments themselves are never shown to anyone.

VisionWeb file uploads. When you upload files to the VisionWeb planning tool, the AI reads them to fill in the empty parts of your plan and to list what is missing. It never overwrites a figure you have already entered, and every figure it fills in shows which document and line it came from, so you can check it. The files are kept on our upload server in the EU for 90 days from when you start, then deleted automatically. Ask us at any time and we will delete them sooner.

AI output is a suggestion for you to review; no decision with legal or similarly significant effects on a person is made by automated means.

7. How Long We Keep Your Data

8. Your Rights Under UK GDPR

You have the right to:

To exercise any of these rights, email nigel@betterbusinessexpert.co.uk. We will respond within 30 days.

You also have the right to lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk or by calling 0303 123 1113.

9. Cookies and Browser Storage

We only store what the site needs to work: your signed-in session (kept in your browser's storage by our sign-in provider, Supabase) and a note that you have seen our cookie message. These are strictly necessary, so they do not need your consent. We do not use analytics, advertising or tracking cookies. If we ever want to, we will ask you first.

10. Security

We use industry-standard security measures including encrypted connections (HTTPS), secure password hashing, email confirmation for new accounts, two-step sign-in (a code from an authenticator app) which is required for account holders and directors or HR who can see everyone's records and available to everyone else, and row-level security in our database so that each business can only reach its own data. No system is 100% secure — if you believe your account has been compromised, contact us immediately.

If a personal data breach occurs that is likely to put people's rights at risk, we will report it to the ICO within 72 hours of becoming aware of it and, where required, tell the people affected (or the business that controls their data) without undue delay.

11. Changes to This Policy

We may update this policy from time to time. We will notify you of significant changes by email. The “last updated” date at the top of this page shows when it was last revised.
